Abstract

The success that the Law "To prevent, punish and eradicate gender-based political violence against women" could have in achieving a "meta-legal effectiveness" (Bandeira & Campos de Almeida, 2015, p. 512) to provoke substantial effects that impact on the socio-cultural factors that today limit the exercise of women's political rights, is still uncertain.
But considering that these factors are the product of a historical social context, it is unquestionable the enormous advance that constitutes being able to name this type of aggressions as forms of abuse that particularly affect women when they reproduce prejudices and discriminatory actions, limit the incentives for the exercise of non-traditional roles and hinder the development of their leadership. The other side of the sanctions against aggressions has to do with prioritizing tactics that encourage and protect women's participation, for which reason the legislative strategy should not be the only or primary response, and other paths must still be analyzed alongside or instead of it.
